Terms and Conditions:
Dear customer. I apologize in advance for the tone of these terms and conditions. As entrepreneurs, we all know how important it is to record your rights and obligations. I hope I never have to refer to these terms. I hope the content doesn't put you off.
1.Applicability;
These general terms and conditions apply to all offers from, agreements with and work performed by 'The striking wedding official'.
2. General;
In these general terms and conditions the following definitions apply:
Ceremony speaker: the extraordinary civil registrar/ceremony speaker who is responsible for the (wedding) ceremony.
Client: any natural person who has entered into or wishes to enter into an agreement with 'The striking wedding official'. Agreement: every offer from 'The striking wedding registrar', accepted by the client, or every assignment given by the client to 'The striking wedding registrar' and accepted by the latter.
Services: in the context of an agreement between 'The striking wedding official' and the client, work performed by 'The striking wedding official'. 'The striking wedding official' reserves the right to engage third parties for the execution of its agreement.
3. Conclusion of the agreement;
An agreement between the client and 'The striking wedding registrar' is concluded after written signing by both parties of the quotation issued by 'The striking wedding registrar'.
4. Honoring a payment;
The quotation provided by ''The striking wedding official' includes VAT and excludes travel costs, excluding accommodation and parking costs and any costs resulting from a one-day appointment in the wedding municipality, unless otherwise agreed in the quotation. When entering into the agreement, the client will be charged € 250.00 (incl. VAT) as an advance. 'The striking wedding official' definitively reserves the date in the agenda after payment. The remaining amount must be paid after the preparatory meeting. All payments must be made within 14 days after invoicing into the bank account designated by 'De Markante Wedding Officiant', unless otherwise agreed in the quotation. If the client does not pay within the set period, he or she is legally in default and 'De Markante Wedding Officiant' can charge statutory interest from that date. The client owes 'The striking wedding officiant' all extrajudicial and judicial costs if they fail to pay a sum due and payable by 'The striking wedding officiant' despite notice of default and if 'The striking wedding officiant' hands over the claim to third parties.
5. Accident/illness/calamities;
In the event of force majeure - such as illness, strikes, transport difficulties, diversions, traffic jams, death or matters that could plausibly be regarded as force majeure - both parties are entitled to terminate the agreement in whole or in part or to temporarily suspend it, without both parties /or third parties can assert a claim for performance and/or compensation. In the event of force majeure, 'The striking wedding official' will carefully and where possible in consultation with the client look for a suitable replacement.
6. Liability;
'The striking wedding officiant' is not liable for any damage that may arise for the client or third parties as a result of services provided by 'The striking wedding officiant', unless there is intent or gross negligence on the part of 'The striking wedding officiant'. '. The compensation to be paid by 'The striking wedding officiant' due to an attributable shortcoming in the execution of the assignment will in any case not exceed the amount of the agreement between 'The striking wedding officiant' and the client (including VAT). 'The striking wedding official' is only liable for direct damage. 'The striking wedding official' is never obliged to compensate loss of profit, business damage, (additional) costs, indirect or direct damage to third parties.
7. Cancellation;
Cancellation by the client must be made in writing (by e-mail) and by registered letter.
In the event of cancellation of the assignment by the client, 'The striking wedding official' will charge the following costs:
In case of cancellation up to 30 days before the start of the (wedding) ceremony, the deposit paid.
In case of cancellation up to 14 days before the start of the (wedding) ceremony, 50% of the total amount.
In case of cancellation in the last 7 days before the (wedding) ceremony, 100% of the total amount.
8. Dissolution;
'The outstanding wedding official' can regard an agreement as dissolved, without judicial intervention and without any notice of default being required, in the event that the client is in default or defaults in the fulfillment of his payment obligations, the client applies for a suspension of payments, his bankruptcy is requested, the client loses the free disposal of his assets or income in whole or in part or if any part of his assets is seized or in the event that the client sells or liquidates his company or 'The striking wedding official' after the conclusion of the agreement circumstances become known, fear that the client will not fulfill obligations. The agreement also ends with immediate effect and without judicial intervention in the event of:
- declaration of bankruptcy or suspension of payment of the client, respectively 'The striking wedding official';
- cessation of the business activities of the client, respectively 'The striking wedding official';
- relocation of the client's business activities, respectively 'The striking wedding official', if this results in disproportionate travel time
- death of the extraordinary registrar of 'The striking marriage registrar';
- illness of the extraordinary registrar of 'The striking wedding registrar' on the day on which the wedding ceremony will take place.
9. Complaints;
Complaints about the work performed by 'The striking wedding official' must be made known by the client in writing within 8 days after the assignment has been carried out, or within 8 days after the circumstance on which the complaint is based has been communicated to the client. has become known. When making the complaint, the nature of the complaint must be clearly described. Complaints about the amount or content of the invoices from 'De Markante Wedding Official' must be made in writing to 'De Markante Wedding Official', Kwendelhof 182, 5044EH Tilburg, 8 days after receipt of the invoice in question, stating the nature of the matter. the complaint. Complaints do not suspend the payment obligation. If it is established that the complaint is unfounded, the costs incurred by 'The striking wedding official' will be fully borne by the client.
10. Confidentiality;
'The striking wedding official' is obliged to maintain confidentiality of all confidential information that she has obtained from any source in the context of this assignment agreement.
11. Disputes;
Disputes will only be submitted for settlement to the competent court of the district in which 'The striking wedding official' has its registered office.
12. Location and changes to conditions;
These conditions have been filed with the Chamber of Commerce North Brabant. The version that applied at the time the agreement was concluded with the client always applies. Dutch law applies to agreements concluded with 'The striking wedding official'.
